Terms and Conditions of Participation in The Arc Junior Ski Development Program

Please read carefully these terms and conditions of contract. Upon acceptance into the program and payment of the deposit, you agree to be bound by these conditions on behalf of your child participant (“your child”), which constitute the agreement between HWH Life Pty Ltd trading as The Arc Junior Skier Development Program (“The Arc”) and you.

No variation of these conditions will be effective unless in writing and signed by a person so authorised by The Arc. Reference to “The Arc representatives” means any staff of The Arc and its officers, employees, agents and other third parties and representatives and the land management authorities in any Program location.

How to Book

To secure your child’s place in the Program you should complete the Enrolment Form and pay the non-refundable 50% deposit for the Program Fee. Places are limited for the Program and will be allocated on a first come first served basis, together with a skills assessment to ensure participants possess the requisite skiing skills and experience. Eligibility will be assessed by The Arc’s expert coaching representatives and will be made at The Arc’s sole discretion.

The Program Fee

Payment of the Program Fee entitles the participant to the inclusions of the Program detailed under ‘Costs and Inclusions’ as detailed on The Arc’s website.

Exclusions from the Program Fee include but are not limited to: flights, transfers, accommodation and meals other than those meals detailed in the Program inclusions; personal travel insurance; visa, passport and any association costs; departure, airport and airline taxes; optional experiences offered by The Arc; all personal and incidental expenses; equipment costs.

Payment of the Program Fee

Upon registration and notification by The Arc that your child is eligible to participate in the Program, a 50% deposit of the Program Fee is due to secure your child’s participation in the Program. Payment of the remaining 50% of the Program Fee is payable no later than 1 December.

Refund/cancellation policy

Other than under our COVID-19 Cancellation Policy below, the 50% deposit is non-refundable. Cancellations for extenuating circumstances such as sickness, death or illness will be extended for 50% of the Program Fee with notification up to 30 days of the commencement of the Program. Written notification of the cancellation must be sent to The Arc via email with substantiating evidence such as a Doctor’s Certificate. Cancellations within 30 days of the commencement of the Program will result in forfeiture of 100% of the Program Fee. Participants should obtain adequate Travel Insurance to cover such forfeiture.

The Program Fee (in full or in part) will not be refunded if any facilities are not operating for any reason or if any portion of the Program is unused; or for failure to arrive at the Program start date, or any day of the Program. Unused Program days are non-refundable and cannot be transferred to another date, person or season.

COVID-19 Cancellation Policy

Up to and including 14 days of the program start date:

The Arc’s COVID-19 Cancellation Policy allows you to receive a full refund for pre-paid Program Fees if Government policies due to COVID-19 prevent you from travelling to Livigno, Italy for participation in the program.

The COVID-19 Cancellation Policy does not cover flights, transfers, accommodation and meals other than those meals detailed in the Program inclusions; personal travel insurance; visa, passport and any association costs; departure, airport and airline taxes; optional experiences offered by The Arc; all personal and incidental expenses; equipment costs.

Within 14 days of the program start date:

The Arc’s COVID-19 Cancellation Policy allows you to receive a credit for pre-paid Program Fees if Government policies due to COVID-19 prevent you from travelling to Livigno, Italy for participation in the program.

Travel Insurance

Personal travel insurance is not included in the Program Fee. It is a condition of registration with The Arc, and your responsibility to ensure that participants are adequately insured for the full duration of the Program in respect of illness, injury, death, and cancellation. Upon registration, please provide evidence to The Arc that you have obtained personal travel insurance for the participants. You must ensure that your personal travel insurance covers all the Program Activities including snow skiing on and off-piste.

Physical Health

As the locations of the Programs are in high altitude alpine environments, and the activities of the Program are physically demanding, The Arc requires all participants to be in good health and physical condition. To ensure the best outcome from the Program, participants are strongly advised to engage in pre-training exercise including cardio and strength training.

Medical Disclosure

You declare and warrant that:

the participant is in good health and mental and physical fitness at the time of registration;
you have disclosed to The Arc every matter concerning the participant’s health and mental and physical fitness of which you are aware, or ought to reasonably be expected to know, that is relevant to participation in the Program;
immediately upon any adverse change in the participant’s health or fitness that may likely affect participation in the Program you will notify The Arc in writing of any such adverse change;
The Arc is permitted to disclose medical information to any consultant doctor. The Arc’s consultant doctor may exclude the participant from the Program if he/she deems it necessary.

You acknowledge that the obligation to disclose under this condition continues from the time of registration through to departure and extends for the duration of the Program. Failure to comply with this condition and if The Arc would not have granted eligibility to the Program had you made full disclosure under this condition, The Arc will not be liable, except to the minimum extent required by law, for personal injury, death or property damage or loss incurred by the participant.

Cancellation due to Program registration numbers

The Arc reserves the right to cancel any Program prior to departure in the event that there are too few people booked in the Program in which case you will be given a full refund of the Program Fee paid by you. You will not be entitled to claim any additional amounts or seek any compensation for any injury, loss, expenses or damage (either direct or consequential) or for any loss of time or inconvenience which may result from such cancellation (including but not limited to flight and accommodation costs, visa, passport charges, or departure, gear purchases, airport and airline taxes).

Program modifications, Postponement or Cancellation

The Arc reserves the right to cancel, postpone, substitute or modify any Program or part of the Program; if, in the discretion of The Arc, it is necessary to do so due to inclement weather, snow (or lack thereof) or icy conditions or any conditions that are likely to be hazardous or dangerous if, in the discretion of The Arc, there is a likelihood of any event occurring which may impact upon the safety of the participants. In the event of any change under this condition, there will be no right of refund of the Program Fee and no right to claim compensation for any injury, loss or damage or other additional expenses incurred. The Arc also reserves, in its absolute discretion, the right to cancel any Program due to any government travel warning or advice, or any change in such warning or advice. Travel insurance may compensate you depending on the circumstances.

Proof of citizenship or information required to travel

It is the responsibility of the participants to obtain proper identification, proof of citizenship and/or vaccinations as required by the authorities of the Program destination. You will not be entitled to a refund if you are denied boarding or entry on any basis, including without limitation, improper documentation or failure to provide information. It is recommended that your passport is valid for six months beyond the date of your return home to your home country.

Airlines, accommodation and other transport providers

Any material published by The Arc, the Registration Form and these conditions are not issued on behalf of, and do not commit any airline, accommodation or transport provider whose services are used or proposed to be used in the course of the Program. If an airline, accommodation or other transport providers’ proposed travel, fare schedule or accommodation is amended or cancelled, such amendment or cancellation will not be considered a cancellation of the Program by The Arc. Any flights, accommodation and other transport forming part of the Program arrangements are subject to the conditions of the provider.

Force Majeure

If The Arc is prevented (directly or indirectly) from performing any of its obligations under this agreement by reason of act of God, strikes, trade disputes, fire, breakdowns, interruption of transport, government or political action, acts of war or terrorism, acts or omissions of a third party or for any other cause whatsoever outside The Arcs’ reasonable control, The Arc will be under no liability whatsoever to you and may, at its option, by written notice to you cancel the Program.

Assumption of risk

You acknowledge and agree that:

the Program’s activities, namely alpine skiing, involve a significant risk of physical harm or personal injury including but not limited to permanent disability and/or death to participants. Any such injury may result not only from the participant’s actions from also from the action, omission or negligence of others. “Activities” means the preparation for, participation in and instruction in alpine activities including but not limited to: alpine skiing and snowboarding, freestyle skiing and Nordic skiing, snowboarding, snow-biking, riding on chairlifts, t-bars and other lift devices (rope tows, magic carpets, etc);
the enjoyment and excitement of participation in the Activities is derived in part from the inherent dangers and risks associated with the Activities and that those inherent dangers and risks are a reason why you wish to undertake the Program;
operational control of some parts of the Program may be in the hands of a third party and your right of action in regard to any shortcomings of that third party’s performance is against the third party and not against The Arc;
the additional dangers and risks associated with participation in the Program may include difficult and dangerous terrain; high altitude; extremes of weather including sudden and unexpected changes; remoteness from medical services and from communications; and evacuation difficulties in the event of serious illness or injury.

Release and discharge from all claims

To the extent permitted by law, by accepting the inherent dangers and risks associated with the Program, you release, waive and discharge The Arc from all claims, actions or losses for personal injury or death, property damage, loss of services, loss of profits, consequential, exemplary, indirect or punitive damages or otherwise which may arise:

out of or occur during your travel in connection with the Program; or
from any activities conducted in or in conjunction with the Program unless caused by the reckless conduct of The Arc or its representatives; or
in connection with any optional activities which you may undertake during the Program but which do not comprise part of the Program and you accept that any assistance given to you by The Arc in arranging such optional activities will not render the The Arc or its representatives liable to you in any way; or
from any acts or omissions of third-party tour operators where The Arc acts as a booking agent for third-party our operators.

Medical release from parents and guardians of child participants

On behalf of your child participant, you:

authorise The Arc and its employees and agents to arrange for medical attention of your child or to transfer your child to the closest medical facility or to a hospital if, in the opinion of that person, medical attention is needed or is likely to be needed for your child:
are aware that the practice of medicine in a surgery is not an exact science and acknowledge that no guarantees have been made as to the result of treatment or examination at the chosen medical facility;
agree that on transporting your child to any hospital or medical facility The Arc shall have no further responsibility, for, or in respect of, your child;
agree to pay all costs associated with such medical care or attention and for related transportation for your child and agree to indemnify and to keep indemnified The Arc for and in respect of any such costs incurred;
authorise The Arc and its employees and agents to render any necessary or emergency medical care or attention to your child if considered necessary by a medical practitioner employed at the chosen medical facility;
authorise The Arc and its employees to administer its Concussion Protocol in the case of any suspected head injury. The Arc’s Concussion Protocol follows the Concussion Recognition Tool as supported by the International Olympic Committee and FIFA, as follows:

Privacy Statement

The Arc collects the personal information requested on this form to enable the efficient provision of the goods and/or services that are requested or required by its clients and to facilitate the administrative functions associated with the provision of the goods and/or services.

Publicity release

By completing the online enrolment form, you hereby unconditionally consent and authorise The Arc to use any and all audio, audio visual, and/or photographic recording of your child relating to the Program (unless otherwise specified by the parent/guardian).

Marketing opt-in

Upon enrolment in the program, you agree to receive all marketing and transactional communications from The Arc.
